Reward Regulation on the Donation of Precious Documents by an Individual or Organization

Article 1
This Regulation is prescribed in accordance with paragraph 2 of Article 14 of the Archives Act (hereinafter referred to as the Act).
Article 2
The term precious documents shall mean documents or information with permanent preservation value under paragraph 1 of Article 14 of the Act.
Article 3
In principle, precious documents shall be donated in originals.
Article 4
If an individual or organization intends to donate precious documents, it may express its intent in writing or verbally to the central archives competent authority. If the intent is expressed verbally, the central archives competent authority shall make a record.
Article 5
Citizens of the Republic of China(ROC) who reside abroad may express their intention to donate precious documents in writing to ROC overseas embassies, consulates, representative offices, offices, or to other agencies authorized by the Ministry of Foreign Affairs or the Overseas Community Affairs Council of the ROC, and then transfer to the central archives competent authority. If the intention of donation is expressed verbally, the central archives competent authority shall make a record for submission. This provision shall be applied to donations by foreigners or foreign organizations.
Article 6
The central archives competent authority may cooperate with the Ministry of Foreign Affairs to deal with the donations of precious documents from foreigners or foreign organizations in accordance with this Regulation and relevant laws and regulations.
Article 7
Before the central archives competent authority accepts a donation of precious documents from an individual or organization, it shall review and ensure that such documents have permanent preservation value in accordance with its directions relevant to Regulation on Appraisal of Records Preservation Value.
The process and result of examination of preceding paragraph shall notify that individual or organization.
Article 8
The central archives competent authority shall render a certificate to the donor to specify the content and quantity of the donated precious documents.
The actual cost of acquisition, as shown in documents proving the donor's acquisition costs, may be noted in the certificate of the preceding paragraph to enable the donor to itemize such donations as deductions or as current-year donation expenses in accordance with the Income Tax Act. When an individual donor is unable to provide documents proving the acquisition costs, the central archives competent authority may, at the donor's request, invite scholars and experts to appraise the value of the precious documents at the time of donation, and the appraised value shall be specified in a certificate.
If there is a condition for donation in paragraph 1, it shall be specified in a written contract.
Article 9
The donation of precious documents in accordance with this Regulation may be notarized or authenticated.
Article 10
The rewards for a donation of precious documents from an individual or organization are as follows:
1. To present a letter of thanks, certificate, medal or trophy.
2. To bestow a plaque.
3. To reduce the access fees to view, hand-copy or duplicate records.
4. To provide the name and a brief introduction of the donor when a donated item is exhibited.
5. To announce information regarding the donation on the website of the central archives competent authority.
The aforementioned rewards in subparagraph 1 and 2 of the preceding paragraph shall be made in public.
When an individual donates duplicate documents, or recommends acceptance of a donation of precious documents and the central archives competent authority accepts the recommendation following review and ensure, the authority may take into consideration the methods provided in subparagraph 1, paragraph 1 when rewarding the donor.
The methods provided in paragraph 1 may be rendered together when necessary.
Article 11
This Regulation shall come into force from the date of the Act coming into force.
Amendments to this Regulation shall come into force from the date of promulgation.
