Article 1
These Regulations are formulated pursuant to Paragraph 2, Article 12 of the Coast Guard Act.
Article 2
For matters to be executed by Coast Guard Administration (hereinafter referred to as CGA) under the trust of Ministry of Transportation and Communications (hereinafter referred to as MOTC) and/or any of its subordinate agencies or organizations according to laws and regulations, the nature of the matters commissioned and the legal basis for such commission shall be published according to Article 15 of Administrative Procedure Act.
Any request of assistance between CGA and MOTC (and/or any of its subordinate agencies or organizations) shall be made in writing according to Article 19 of Administrative Procedure Act with the exception of an emergency. If the request is made in any form other than in writing, a later submittal of written information shall be followed.
Article 3
In carrying out its assignments according to laws, CGA may duly request MOTC and/or any of its subordinate agencies or organizations to provide intelligence and information on criminal activities as well as information required for criminal investigation for joint efforts to fight against crimes.
Article 4
To facilitate the completion of missions, CGA and MOTC (and/or any of its subordinate agencies or organizations) may, depending on the need of their missions, create among them a mechanism for negotiation, and request the other parties to provide information including but not limited to meteorology, hydrology, vehicle registration information, vessel registration information, and other information as well as communication resources required by laws and regulations.
CGA and MOTC (and/or any of its subordinate agencies or organizations) shall establish a reporting center, keep close contacts, and immediately notify one another in case of any emergency or major condition.
Article 5
Any failure to reach an agreement in the performance of their duties according to laws by and between CGA and MOTC (and/or any of its subordinate agencies or organizations) shall be referred to OAC and MOTC for negotiation and settlement.
Article 6
These Regulations shall come into force as of the date of promulgation.
