Regulations Governing Coordination & Liaison between Coast Guard Administration and Council of Agriculture, Executive Yuan

Article 1
These Regulations are formulated pursuant to Paragraph 2, Article 12 of the Coast Guard Act.
Article 2
Coast Guard Administration (hereinafter referred to as CGA) and Council of Agriculture, Executive Yuan (and/or any of its subordinate organizations as well as any agriculture or fishery organization under the supervision of Council of Agriculture) (hereinafter collectively referred to as the Agriculture Organization), in carrying out the matters specified by laws related to agriculture, forestry, fishery, and livestock farming (hereinafter referred to as Agriculture Laws) within the jurisdiction of OGA, shall comply with the following regulations:
1. After having duly processed any case of violation against the laws in the course of duly performing its duties in the areas including sea territories, coastlines, estuaries, and non-trading ports, CGA shall refer the case which is found also involved in violation against the Agricultural Laws to the Agriculture Organizations along with relevant evidences for further process.
2. Should the case referred in the preceding subparagraph involve the professional area of agriculture, OGA may coordinate with the Agriculture Organization to seek assistance if deemed necessary at its own discretion.
3. For matters that must be duly executed by CGA under the commission of the Agriculture Organization shall be handled according to Paragraph 2 and Paragraph 3 of Article 15 of the Administrative Procedure Act. To facilitate carrying out the matters commissioned, a relevant operation process flow shall be developed.
Upon discovery of any case that should be investigated and processed by the other party within the jurisdiction of CGA, the CGA or the Agriculture Organization shall make necessary disposition and immediately notify the other party.

Article 3
Any request for assistance between CGA and the Agriculture Organization shall be made in writing with the exception of an emergency. If the request is made in any form other than in writing, a later submittal of written information shall be followed.
Article 4
CGA and the Agriculture Organization shall establish a relevant communication, information network and database linking and exchanging system, keep close contacts, share the resources, and notify each other immediately in case of any emergency or major incident.
Article 5
CGA and the Agriculture Organization may, for the purpose of improving coordination and liaison between them, have their subordinate organizations to hold a regional meeting, in which contents, approaches and coordination of the matters to be carried out according to laws shall be discussed depending on the practical needs of the region.
If and when necessarily, any other organizations may be invited to present in the meeting referred in the preceding paragraph.

Article 6
CGA may request the Agriculture Organization to provide professional education and training on fishery identification, etc. for personnel of the Coast Guard with the expenditures incurred to be paid from the budget prepared by CGA.
Article 7
Any failure to reach an agreement in the performance of their duties according to laws or in the request of mutual support by and between CGA and Council of Agriculture (and/or any of its subordinate agencies or organizations) shall be referred to Ocean Affairs Council and Council of Agriculture, Executive Yuan for negotiation and settlement.
Article 8
These Regulations shall come into force as of the date of promulgation.
